The following Terms and Conditions ("Terms") dictate your access to and use of the WEAR APP mobile application (the "App"), the WEAR APP website (the "Website"), and any related services provided by WEAR APP SARL ("we", "us", or "our"). By accessing or using the App, Website, or our services, you consent to these Terms. If you disagree with any portion of these Terms, you are prohibited from accessing or using the App, Website, or our services.

1 - Terminology

• Account: An account created by an App or Website user.
• Content: Any text, graphics, images, videos, audio, or other materials uploaded to or displayed on the App or Website.
• Seller: A user who lists products for sale on the App or Website.
• Buyer: A user who purchases products through the App or Website.
• Product: Any item of clothing, footwear, or accessories listed for sale on the App or Website.
• Transaction: The purchase and sale of a Product facilitated by WEAR APP.

2 - User Accounts

• You may need to create an Account to access certain features of the App or Website.
• You are accountable for maintaining the confidentiality of your Account information, including your username and password.
• You are accountable for all activity that occurs under your Account.

3 - User Conduct

• You consent to use the App, Website, and our services in a lawful and respectful manner.
• You will not use the App, Website, or our services for any illegal or unauthorized purpose.
• You will not infringe on the intellectual property rights of any third party.
• You will not upload any Content that is hateful, discriminatory, or obscene.
• You will not impersonate any other person or entity.

4 - Product Listings and Transactions

• Sellers are responsible for ensuring the authenticity and quality of the products they list on the App or Website. All products undergo a rigorous authentication process by a qualified third party before being shipped to the Buyer.
• Buyers are responsible for carefully reviewing product descriptions and images before making a purchase.
• WEAR APP facilitates Transactions by acting as a middleman. We handle the collection of payment from the Buyer, secure storage and authentication of the Product, and shipment to the Buyer.
• The total price you see displayed for a Product includes the purchase price and the shipping fee.
• WEAR APP charges a service fee for facilitating Transactions. This service fee is already incorporated into the final displayed price.

5 - Payment Processing

• WEAR APP uses a secure third-party payment processor to handle all financial transactions.
• You consent to comply with the terms of service of the payment processor used by WEAR APP.

6 - Shipping

• WEAR APP is accountable for arranging secure shipping of all Products purchased through the platform.

7 - Returns and Refunds

• WEAR APP offers a return policy for all Products. You can find more information about our return policy on the App or Website.
• In the event of a return, WEAR APP will facilitate the return process and issue a refund to the Buyer, minus any applicable fees.

8 - Intellectual Property

• The App, Website, and all content included therein are the property of WEAR APP SARL or our licensors.
• You are prohibited from using any of our intellectual property without our express written permission.

9 - Disclaimers

• The App, Website, and our services are provided "as is" and without warranties of any kind, express or implied.
• We disclaim all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee the accuracy, completeness, or reliability of any Content on the App or Website.

10 - Limitation of Liability

• We will not be liable for any damages arising out of your use of the App, Website, or our services.
• This includes, but is not limited to, direct, indirect, incidental, consequential, or punitive damages.

11 - Changes to the Terms

• We may revise these Terms at any time by posting the revised Terms on the App or Website.
• Your continued use of the App, Website, or our services after the revised Terms are posted constitutes your agreement to be bound by the revised Terms.
